ISLAND2ISLAND BEVERAGES/ANGOSTURA “COCKTAIL CHALLENGE, WIN A TRIP TO TRINIDAD” PROMOTION

 

HOW TO ENTER AND PROMOTIONAL PHASES

 

PHASE 1 – GENERAL ENTRIES

 

  1. To enter, eligible entrants must visit the island2island Beverages Facebook Page (facebook.com/i2ibeverages) between 15/05/2015 and midnight (AEST) on 15/06/2015 and follow the prompts to the Angostura Cocktail Challenge application.

 

  1. Entrants must indicate that they ‘like’ the island2island Beverages Facebook Page (if they have not already done so) and enter the details of one (1) original cocktail recipe (including the name of the cocktail, list of ingredients, a description of how to make the cocktail and the type of glass the cocktail should be served in) and upload an original photograph of the created cocktail.

 

  1. The following conditions must be met when developing the cocktail recipe:

 

  1. The cocktail must have a minimum of five (5) dashes of Angostura aromatic bitters and a minimum of 30ml of any Angostura Rum: Reserva, 5 year old, 7 year old, 1919 or 1824;
  2. Any additional ingredients must be from the island2island portfolio where applicable;
  3. Cocktails must have a least three (3) ingredients and no more than six (6) ingredients (excluding garnishes and ice);
  4. Cocktail recipes must easily demonstrate the versatility of the Angostura beverages and the way in which the Angostura beverages can be mixed with other ingredients;
  5. Ingredients containing alcohol must be measured with a jigger, dropper or other acceptable measurement (the use of dashes is limited to the bitters ingredients);
  6. Ingredients not containing alcohol can be measured or free poured.
  7. All ingredients used in the cocktails must be readily available around the world;
  8. Garnishes must be mostly edible;
  9. Cocktail picks may be used to fix any garnish to the glass;
  10. Homemade ingredients are unable to be used; and
  11. Measurements must be expressed in millilitres and drops (the use of dashes is limited to the bitters ingredients).

 

  1. Failure to comply with any of these conditions in Phase 1 will result in the entry being invalidated. Failure to comply with any of these conditions in any further phases of the promotional activity will result in loss of points and possible disqualification.

 

  1. In Phase 1, cocktails will be individually judged by the Promoter based on creativity, originality and compliance with these Terms and Conditions.

 

PHASE 2 – SEMI-FINALIST EVENTS

 

  1. Five (5) semi-finalists will be selected by the Promoter from each State/Territory in Australia to take part in a further competition, where they will be required to make their cocktail recipe for a panel of judges. These semi-finalists will be notified by email and telephone.

 

  1. Semi-finalists will be required to make two (2) of their cocktail recipes within seven (7) minutes (one (1) version for the judges to taste and one (1) version for a photograph). The cocktails will each be taste-tested by a panel of judges. Cocktails will be individually judged based on appearance, aroma, taste and presentation. Entrants will receive up to 5 points for the ‘appearance’ category, up to 5 points for the ‘aroma’ category, up to 25 points for the ‘taste’ category and up to 15 points for the ‘presentation’ category.

 

  1. The Phase 2 semi-finalist events will take place in each State/Territory between 27/07/2015 and 17/08/2015. The Promoter will notify each semi-finalist of the exact date, time and location of the semi-finalist events once semi-finalists have been selected and verified.

 

  1. Semi-finalists will be fully responsible for making their own way to the semi-finalist events (at their own cost). For the avoidance of doubt, the only prize offered to semi-finalists is the opportunity to participate in a semi-finalist event. Any and all costs associating with participating are a semi-finalist’s sole responsibility.

 

PHASE 3 – THE FINALIST EVENT

 

10. One (1) semi-finalist from each State/Territory will be selected by the judges (based on the criteria outlined above) to take part in the finalist event and compete against other qualifying finalists. Each finalist will be notified by email and telephone.

 

11. Finalists (excluding the finalist from NSW) will be flown to Sydney, NSW for one (1) day, and one (1) night, during the week commencing 31/08/2015. The Promoter will notify each finalist of the exact date once finalists have been selected and verified. Finalists will compete in the finalist event to determine one (1) overall Australian winner (“Overall Winner”). Finalists (including the finalist from NSW) will also receive one (1) night accommodation in Sydney.

 

12. Finalists will be required to once again make their cocktail recipe. Finalists will be required to make two (2) of their cocktail recipes within seven (7) minutes (one (1) version for the judges to taste and one (1) version for a photograph) for the opportunity to be declared the Overall Winner.

 

13. The cocktails will each be taste tested by a new panel of judges. Cocktails will once again be judged based on appearance, aroma, taste and presentation in order to determine the Overall Winner. Entrants will receive up to 5 points for the ‘appearance’ category, up to 5 points for the ‘aroma’ category, up to 25 points for the ‘taste’ category and up to 15 points for the ‘presentation’ category.

 

14. The top-scoring entrant will win a trip to Trinidad in February 2016 to compete in the Angostura Global Cocktail Challenge (see below for more details). The second highest scoring entrant and the third highest scoring entrant will win stock prizes (see below for more details).

 

TERMS AND CONDITIONS

 

15. Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions. The Overall Winner is also required to comply with the Rules and Conditions for the Angostura Global Cocktail Challenge (as supplied to the Overall Winner).

 

16. Entry is only open to Australian residents aged 18 years or over who:

 

  1.  are currently working as a bartender in Australia;
  2. have a valid Facebook account to be able to access the promotion;
  3. have a valid passport; and
  4. are able to travel to Trinidad in February 2016 (if chosen to compete in the Angostura Global Cocktail Challenge).   

 

17. Individuals who make it through to Phase 3 will be competing against other entrants from Australia. The individual who makes it through to the Angostura Global Cocktail Challenge will be competing against other entrants from all over the world, and will be responsible for ensuring that they have a valid passport, and any requisite visas, vaccinations and travel documentation, for travel to Trinidad in February 2016.

 

18. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

 

19. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence as well as their place of employment) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

 

20. Incomplete, indecipherable or illegible entries will be deemed invalid.

 

21. Only one (1) entry permitted per person.

 

22. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

 

23. This is a game of skill and chance plays no part in determining the winners.

 

24. The Promoter’s decision regarding any aspect of this activity is final and no correspondence will be entered into.

 

25. The following conditions apply to those entrants who are selected to make their cocktail for judging in further phase(s) of the promotional activity (i.e. in Phase 2, Phase 3 or during the Angostura Global Cocktail Challenge):

 

  1. In the event that an entrant cannot attend a judging phase, the Promoter reserves the right to disqualify that entrant and may select an additional entrant to take part in the judging phase in its discretion. Alternatively, the Promoter may, in its absolute discretion, elect to conduct the judging phase with the remaining entrants only;
  2. Garnishes cannot be pre-prepared and must be prepared within the seven (7) minute time allowance;
  3. If an entrant fails to include all ingredients declared in their original cocktail recipes submitted at the time of entry or includes a further ingredient when making their cocktails for the judges at any stage, they will lose three (3) points from their score (as determined by the judges);
  4. If an entrant exceeds the allocated time limit when making their cocktails, they will lose five (5) points from their score (as determined by the judges) for each thirty (30) seconds they exceed the seven (7) minute time allowance;
  5. Angostura Rum, Angostura Bitters and basic garnishes (i.e. cocktail cherries, olives, lemons, limes and oranges) will be provided by the Promoter at each judging phase, however, entrants will be required to supply all other ingredients (including mixers and additional garnishes) as well as any bar utensils and/or devices and any specific glassware the entrant needs to use in making their cocktail; and
  6. In the case of a tie for any prize, the tied entrant with the highest score in the ‘taste’ category will be deemed the relevant prize winner. In the event of a further tie, the Promoter will determine the relevant prize winner in its absolute discretion.

 

26. Each Australian finalist (i.e. each Australian entrant that makes it through to Phase 3) will receive the following:

 

  1. Return economy airfare (for one (1) person) from their nearest capital Australian city to Sydney (not provided for the NSW finalist);
  2. One (1) night accommodation in Sydney; and
  3. Transfers to the finalist event.

 

27. Spending money, meals, insurance, transport to and from departure point, additional transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. For the Sydney finalist, the prize does not include airfare and the airfare component of the prize is not redeemable for cash.

 

28. The Overall Winner will receive a trip to Trinidad to compete in the Angostura Global Cocktail Challenge during Carnivale along with AU$10,000 cash and a 12 month contract as the Australian Angostura Brand Ambassador. The trip is valued at up to AU$14,000, depending on the winner’s point of departure and includes return economy airfare (for one (1) person) from the winner's nearest Australian capital city to Trinidad, seven (7) night’s accommodation, opportunity to compete in the Angostura Global Cocktail Challenge and a distillery tour with Master Distiller, John Georges.

 

29. Additional spending money, meals, taxes, insurance, passports, visas, vaccinations, transport to and from departure point, transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. The Overall Winner must depart Australia in February 2016 in order to take this prize (subject to booking and flight availability). Cash prize will be awarded in the form of a cheque.

 

30. The Overall Winner will be required to attend the Angostura Global Cocktail Challenge February 2016 and make their cocktail recipe. The Overall Winner will be competing against other bartenders from around the world for a further prize.

 

31. The Angostura Global Cocktail Challenge will be conducted in accordance with the Angostura Global Cocktail Challenge Rules and Conditions (which will be provided to the finalists). The winner of the Angostura Global Cocktail Challenge will receive US$10,000 cash and a 24 month contract as the Global Angostura Brand Ambassador

 

32. The second highest scoring finalist in the Phase 3 Finalist Event will win stock prizes, which may include Angostura rum and bitters products, to be determined by the Promoter in its sole discretion.

 

33.  The third highest scoring entrant in the Phase 3 Finalist Event will win stock prizes, which may include Angostura rum and bitters products, to be determined by the Promoter in its sole discretion.  

 

34. Participation in any event is subject to the event venue and organisers terms and condition. The Promoter and event organisers hereby expressly reserve the right to eject any winner for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of an event.

 

35. Where travel is included in a prize (i.e. Phase 3 prize and Overall Winner prize), the following conditions also apply:

 

  1. Travel is subject to booking and flight availability;
  2. Frequent flyer points will not form part of the prize;
  3. Travel is subject to the standard terms and conditions of individual prize and service providers; and
  4. Participants may be required to present a credit card at the accommodation check in.

 

36.  If for any reason a winner does not redeem their prize (or an element of the prize) at the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.

 

37. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification.

 

38. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.

 

39. When an entrant submits or creates any materials as part of this promotional activity, including the details of their cocktail recipe (“Content”), the entrant, unless the Promoter advises otherwise, licenses and grants the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display such Content for any purpose in any media, without compensation, restriction on use, attribution or liability. Entrants agree not to assert any moral rights in relation to such use and warrant that they have the full authority to grant these rights.

 

40. Entrants agree that they are fully responsible for the Content they create and submit. The Promoter shall not be liable in any way for such Content to the full extent permitted by law. The Promoter may invalidate any Content without notice for any reason whatsoever. Entrants warrant and agree that: (a) they will not submit any Content that is unlawful or fraudulent, or that the Promoter may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication;; (b) they will obtain full prior consent from any person who has jointly created or has any rights in the Content, to the uses and terms herein; (c) the Content shall not contain viruses or cause injury or harm to any person or entity; (d) the Content is the original artistic and literary work of the entrant that does not infringe the rights of any third party; (e) they consent to any use of the Content which may otherwise infringe the Content creator’s/creators’ moral rights pursuant to the Copyright Act 1968 (Cth) and warrant that they have the full authority to grant these rights; and (f) they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content and the access or use of others’ computer or communication systems.

 

41. Without limiting any other terms herein, entrants agree to indemnify the Promoter for any breach of the above terms.

 

42. As a condition of entering this promotion, each entrant agrees to assign all of their rights, title and interest (including copyright) in and to their entry (which shall include Content) to the Promoter, and to execute any documents to confirm such assignment. Entries will not be returned to any entrant.

 

43. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a semi-finalist, finalist or winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

 

44. The Promoter reserves the right to develop and produce any cocktail submitted by any entrant (including those entrants that do not progress past Phase 1 of the promotion), including any modifications as the Promoter sees fit, and to sell the cocktail for an unlimited period of time without any further reference, remuneration, payment or other compensation to the entrant that created the cocktail.

 

45. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.

 

46. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion, or suspend or modify an event or a prize.

 

47. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the internet service provider used.

 

48. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

 

49. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if any event in the promotion (including the distillery tour with Master Distiller, John Georges) is cancelled, delayed or rescheduled for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or entrant; or (g) use of a prize or participation in a prize event.

 

50. The distillery tour with Master Distiller, John Georges, awarded to the Overall Winner, provides the Overall Winner with an opportunity to meet John Georges, and an opportunity to have a distillery tour with John Georges. These elements of the prize are not guaranteed and are subject to the goodwill and availability of John Georges on the day. The Promoter accepts no responsibility and will not offer any alternative in the event that these elements of the prize cannot be offered for any reason.

 

51. Winners may be required to sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form. The Overall Winner/international winner will also be required to sign a further agreement, in a form determined by the Promoter in its absolute discretion, setting out their obligations with respect to participation in media interviews, photographic sessions, and other media related marketing, advertising, promotional and/or publicity activities as the Australian/Global Angostura Ambassador.

 

52. The Promoter collects personal information (“PI”) in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at www.island2island.com.au/privacy-site-terms.php. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter.  Unless otherwise indicated by the Promoter, the Promoter may disclose personal information to entities outside of Australia (including to Trinidad for the purpose of entry selection. 53. Entry and continued participation in the promotion is dependent on entrants following and acting in accordance with the Facebook Statement of Rights and Responsibilities, which can be viewed at www.facebook.com/terms.php.

 

54. This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants understand that they are providing their information to the Promoter and not to Facebook. The information an entrant provides will only be used for the purposes outlined in these Terms and Conditions. Any questions, comments or complaints about this promotion must be directed to the Promoter and not to Facebook. Facebook will not be liable for any loss or damage or personal injury which is suffered or sustained by an entrant, as a result of participating in the promotion (including taking/use of a prize), except for any liability which cannot be excluded by law.

 

55. The Promoter encourages consumers to enjoy responsibly. Legal aged consumers are advised to consider the safe drinking levels recommended in the National Health & Medical Research Council Australian Alcohol Guidelines that are available at www.nhmrc.gov.au/publications/synopses/ds10syn.htm. Entry and continued participation in this promotion is subject to the licensee’s liquor serving policy.

 

56. The laws of Australia apply to this promotion to the exclusion of any other law.  Entrants submit to the exclusive jurisdiction of the courts of Australia.
