“ELIT ART OF THE MARTINI COMPETITION”

 

TERMS AND CONDITIONS

 

PHASE ONE – ELIGIBILITY AND BARTENDER ENTRY SUBMISSION

 

  1. Subject to clause 2 below, entry into Phase One of the promotion and continued eligibility is only available to residents of the Melbourne and Sydney metropolitan region aged 18 years or over who: (a) are employed as a bartender in a high end bar in either Melbourne or Sydney for the duration of the promotional period; (b) are experienced in creating premium cocktails to a high standard; (c) receive an invitation from the Promoter to participate in this promotion; (d) are able to agree and gain permission from the bar owners/managers to on site visits at their bar (where they are employed) and to their elit Cocktail being promoted on their bar’s social media channels if selected as a Top Entrant; and (e) are available and able to travel to the Finals Events to be held in Sydney (for Sydney entrants) on 12 June 2017 and in Melbourne (for Melbourne entrants) on 13 June 2017 if selected as a Finalist, and to the international bartender challenge in Ibiza to be held between 21/09/2017 and 24/09/2017, if selected as a Major Prize Winner.

 

  1. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter or vote. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

 

  1. Phase One begins on 1st March 2017 and ends at 11.59pm AEDST on 24th March 2017 (“Submission Period”).

 

  1. To enter, eligible individuals must, during the Submission Period, complete the following steps:

 

a)    Create an original spirit on spirit martini using elit by Stolichnaya as the base (“elit Cocktail”). The elit Cocktail must meet the following criteria:

 

  1.                       I.        No muddled fruit, juices and/or syrups should be used. Fruits, herbs, essences and spices may be used in infusions;
  2.                     II.        Modifiers such as fortified wines, bitters, tinctures, infusions and citrus oils are acceptable variables;
  3.                    III.        The ratio of modifier to base spirit should never exceed 50:50;
  4.                   IV.        Garnish may be traditional such as citrus twist or olives, however individuals are encouraged and permitted to let their imagination go wild in this respect;
  5.                    V.        The elit Cocktail can be served up or on the rocks. In addition, it may be shaken or stirred.

 

 

In the event that an individual has created an original cocktail(s) that suits the above criteria in the past (and may even be selling the cocktail at their current bar of employment), then they may use that cocktail to enter (subject to permission of their employer); and then

 

b)    Send an email to BPage@island2island.com.au containing the following:

 

  1.                   i.        their first and last name, the name and address of the bar they are employed at, their City, valid email address and telephone number;
  2.                 ii.        a name for their elit Cocktail, the recipe for their elit Cocktail, including a full list of ingredients and directions on how to make their elit Cocktail; and
  3.                iii.        a photograph of their elit Cocktail (as an attachment in the email).

 

  1. Attachments must be submitted in JPG or GIF format and must not exceed 5MB file size. Images submitted must be in compliance with these Terms and Conditions.

 

  1. There is a strict limit of one (1) entry per person into Phase One of the promotion.

 

PHASE TWO – SELECTION OF TOP ENTRANTS IN EACH STATE

 

  1. For the purposes of Phase two, all entries received in Phase One will be divided into groups according to the entrant’s city of residence (each a “City”), as follows:
  • Sydney; and
  • Melbourne.  
  1. The Promoter will judge entrants in each City against other entrants in that City on the basis of the following criteria: 

 

  • · Observance of the criteria as outlined in clause 4(a);
  • · Taste;
  • · Presentation;
  • · Uniqueness/Creativity;
  • · elit Cocktail name;
  • · How well elit by Stolichnaya Vodka is utilised in the elit Cocktail.
  1. The Promoter will select the best entries, based on the above criteria, in each City and deemed them to be “Top Entrants”. The exact number of Top Entrants will be determined by the Promoter in its absolute discretion, depending on the overall quality of the entries received.

 

  1. Entrants will be notified via email whether or not they were selected as a Top Entrant.

 

  1. Each of the Top Entrants selected in each City will be required to provide proof of age and identification (to the satisfaction of the Promoter) to validate their entry. Failure to provide the proof of age and identification when requested by the Promoter will result in invalidation of the entry and disqualification of the entrant.

 

PHASE THREE – ON SITE VISITS, SOCIAL MEDIA PROMOTION AND FINALIST SELECTION

 

  1. Phase Three begins on 1st April 2017 and ends at 11.59pm AEST on 31st May 2017  (“Phase Three Period”).

 

  1. As part of Phase Three Period Top Entrants will be required to promote their elit Cocktail in their bar (where they are employed) and on social media of their bar for the duration of the Phase Three Period. In addition, Each Top Entrant will be contacted via email and telephone to arrange three (3) on-site visits at their bar by the Promoter’s representatives (during the Phase Three Period). Top Entrants must agree to a visit in their bar of employment on times and dates reasonably specified by the Promoter to remain eligible. It is the Top Entrant’s responsibility to obtain consent from their employer for the on site visit, and for the promotion of their cocktail in Phase Three Period on their bar’s social media. Bartenders must also keep any lids from sales of elit by Stolichnaya Vodka bottles to assist in the judging process of the third on site visit (as outlined below in clause 14). For the sake of clarity, in the event that a Top Entrant is unable to (for any reason) or is unwilling to agree to an on site visit or social media promotion on their bar’s social media pages during the Phase Three Period, that Top Entrant will be disqualified.

 

  1. Each on site visit will occur at an exact time and date agreed to between the Promoter and each Top Entrant, however, if agreement cannot be reached the on site visits will occur at the time/date reasonably specified by the Promoter. The visits will be conducted as judged as follows:

 

  1. Visit One – Tasting and judging by judges selected by the Promoter in its sole discretion. Each Top Entrant will need to make their elit Cocktail and present it to for review and judging during the visit. A score out of 30 will be allocated to this visit, and the score will be based on the criteria in Schedule 1 (Judging Template Stage 1);
  2. Visit Two – Local representative of the Promoter will visit to judge the extent of the promotional activity in the bar and social media of the bar around the elit Cocktail and assess progress of the elit Cocktail sales and promotion. A score out of 30 will be awarded by the Promoter’s representative, based on the criteria in Schedule 1 (Judging Template Stage 1); and
  3. Visit Three – Final visit by a local representative of the Promoter at the end of the Phase Three Period which will be used to evaluate the overall success of the elit Cocktail, and namely the volume and increase in sales of elit by Stolichnaya Vodka. Individuals will be required to produce lids of each Stolichnaya elit Vodka bottle sold during the Phase Three Period as part of this process. A score out of 40 will be awarded based on the criteria in Schedule 1 (Judging Template Stage 1). As part of the assessment, the venues previous sales of elit by Stolichnaya Vodka may be used for comparison purposes when determining the total score).

 

  1. Eight (8) Top Entrants with the highest scores in Phase Three in each City, based on the above criteria (out of a possible 100), will each be selected as a finalist (“Finalists”). The Finalists will each be required to attend and compete in the finals event to be held in Sydney (for Finalists from Sydney) on 12 June 2017 and in Melbourne (for Finalists in Melbourne) on 13 June 2017 at an exact location determined by the Promoter (“Finals Event”).  

 

  1. In the event of a tie for a Finalist placement in any City, the tie will be broken based on who of the tied Top Entrants scored the highest in Visit One. In the event of a further tie, the tie will be broken based on who of the tied Top Entrants scored the highest in Visit Two. In the event of a further tie, the tie will be broken based on who of the tied Top Entrants scored the highest in Visit Three. Any further ties will be broken by a Promoter’s representative based on which of the tied elit Cocktail they deem to be the best tasting.

 

PHASE FOUR – FINALS EVENT AND WINNER SELECTION

 

  1. Any costs associated with attending the Finals Event, including but not limited to transfers, will be the responsibility of each Finalist and will not be borne by the Promoter.

 

  1. In the event that a Finalist is unable to travel and fails to attend the Finals Event, the Promoter reserves the right to disqualify that Finalist and may select an additional Finalist in its discretion. Alternatively, the Promoter may, in its absolute discretion, elect to conduct the Finals Event with the remaining Finalists only.

 

  1. At the Finals Event, Finalists will be required to recreate their cocktail for the Finals Event as well as compete in a Mystery Challenge round. The Mystery Challenge will be designed to showcase how well the Finalists are able to think on their feet and full details of the requirements of the Mystery Challenge will be communicated to the Finalists during the Finals Event. During the Finals Challenge, Finalists will be required to create three (3) of their elit Cocktail and three (3) of the Mystery Challenge round cocktail in a total of fifteen (15) minutes and then present them to the judges at the Finals Event. Ingredients for each cocktail will be provided by the Promoter at the Finals Event. 

 

  1. A panel of judges selected by the Promoter will then judge the cocktails made by each entrant and allocate a score in accordance with the judging criteria attached as Schedule 2 (Judging Template Final) at the end of this document.

 

  1. The Finalist from each City with the highest score in their City, based on the criteria in Schedule 2 (Judging Template Final), will each be a winner and will win the major prize, as outlined in clause 24 (“Major Prize Winners”).

 

  1. In the event of a tie in any City, the tie will be broken based on who of the tied Finalists made the best impression on the judges, as determined by the judges in their absolute discretion, when presenting their elit Cocktail and their Mystery Challenge cocktail.

 

  1. The Major Prize Winners will be announced at the Finals Event and may also published on the Promoter’s social media and other publicity channels (as determined by the Promoter).

 

ELIT ART OF THE MARTINI GLOBAL COMPETITION

 

  1. Each Major Prize Winner will win a trip for one (1) adult to Ibiza, Spain to compete in the elit Art of the Martini Global Competition, valued at up to AU$6,000 depending on point of departure. Each prize includes:
  • An opportunity for the Major Prize Winner to compete in the elit Art of the Martini Global Competition held in Ibiza Spain between 21/09/2017 and 24/09/2017. The elit Art of the Martini Global Competition will be subject to separate rules and conditions, to be provided to the Major Prize Winners prior to the competition. The Major Prize winner must follow the Promoter’s and event organiser’s directions while participating at the competition;
  • Return economy airfares to Ibiza, Spain, from the Major Prize Winner’s nearest capital city;
  • 3 nights accommodation in Ibiza, at a hotel selected by the Promoter; and
  • All food and beverage costs associated with the official proceedings at the elit Art of the Martini Global Competition (anything the Major Prize Winners do outside of this will be at their own expense)
  • Selected transfers in Spain.

 

Other than mentioned above, spending money, meals, taxes (excluding airfare and airport taxes), insurance, passports, visas, vaccinations, transport to and from departure point, additional transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. The major prize must be taken on the exact dates determined by the Promoter to coincide with the elit Art of the Martini Competiton held between 21/09/2017 and 24/09/2017, and is subject to booking and flight availability. The Promoter will notify the Major Prize Winners of the exact dates of travel once the Major Prize Winners have been selected and notified.   

 

Each Major Prize Winner is responsible for ensuring that he/she has valid passports, and any requisite visas, vaccinations and travel documentation. It is the Major Prize Winner’s responsibility to ensure that they are eligible to leave Australia and travel to Ibiza. In the event that a Major Prize Winner is prevented from leaving Australia or entering Spain by the relevant customs officials, the major prize will be forfeited by the Major Prize Winner and cash will not be awarded in lieu of the prize.

 

Itinerary to be determined by the Promoter in agreement with each Major Prize Winner but in the event that agreement can not be reached, the Promoter reserves the right to determine the itinerary. Frequent flyer points will not form part of the major prize. Each Major Prize Winner may be required to present their credit card at time of accommodation check in. The major prize is subject to the standard terms and conditions of individual prize and service providers.

 

GENERAL

 

  1. Information on eligibility, entry and submission requirements and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

 

  1. All entries and submissions made in the promotion are subject to the conditions outlined in this clause (and these Terms and Conditions generally) including the following:

 

  1.        i.         Submissions/entries must be in English;
  2.      ii.         Submissions/entries must not contain any trademarks, logos, brands, or products or any other intellectually property not owned by the entrant/Finalist (other than as approved by the Promoter); and
  3.     iii.          The conditions outlined in clause 34 of these Terms and Conditions.

 

  1. Entries/submissions that do not comply with these Terms and Conditions or that otherwise contain prohibited, or inappropriate content, as determined by the Promoter, in its sole discretion, will be disqualified and will not be considered eligible. The Promoter makes the final determination as to which submissions are eligible to take part in this promotion and no correspondence will be entered into. All judges will be selected by the Promoter in its absolute discretion.

 

  1. Entrants must use the same elit Cocktail that they submit at the point of entry thought-out all of the phases of the Promotion and can only change the ingredients in the cocktails with the Promoter’s permission, which may be withheld at the Promoter’s discretion.

 

  1. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of employment and residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry or judging process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

 

  1. Incomplete or indecipherable entries will be deemed invalid.

 

  1. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
  2. This is a game of skill and chance plays no part in determining any Top Entrant, Finalist or Major Prize Winner. 

 

 

  1. The Promoter’s and the judges’ decision is final in relation to all aspects of this promotion and no correspondence will be entered into.

 

  1.  When an entrant submits any materials via the promotion including comments, recipes, images, written submissions and recordings (“Content”), the entrant, licenses and grants the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display such Content for any purpose in any media, without compensation, restriction on use, attribution or liability. Entrants agree not to assert any moral rights in relation to such use and warrant that they have the full authority to grant these rights.

 

Entrants agree that they are fully responsible for the Content they submit. The Promoter shall not be liable in any way for such Content to the full extent permitted by law. The Promoter may remove any Content, where such content is published, without notice for any reason whatsoever. Entrants warrant and agree that: (a) they will not submit any Content that is unlawful or fraudulent, or that the Promoter may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication; (b) they will obtain prior consent from any person or property that appears in their Content; (c) the Content is their original work and/or they will obtain full prior consent from any person who has jointly created or has any rights in the Content, to the uses and terms herein; (d) their Content shall not contain viruses or cause injury or harm to any person or entity; and (e) they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems.

 

Without limiting any other terms herein, the entrant agrees to indemnify the Promoter for any breach of the above terms.  

 

  1. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a Top Entrant, Finalist or a Major Prize Winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

 

  1. As a condition of being selected as a Finalist or a Major Prize Winner, entrants agree to participating in any and all reasonable advertising, marketing, promotional and/or publicity activities organised by the Promoter and no further payments will be made in respect to such activities. This includes but is not limited to being filmed, photographed and interviewed during the on site visits, Finals Event or the elit Art of the Martini Competition.

 

  1. If for any reason a winner does not take a prize (or an element of a prize) by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.

 

  1. If a prize (or part of a prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification.

 

  1. The prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.

 

  1. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.

 

  1. Any cost associated with participating in the promotion, other than as outlined in these Terms and Conditions, are the entrant’s responsibility.

 

  1. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in VIC and NSW (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

 

  1. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if an onsite visit, the Finals Event or the elit Art of the Martini Global Competition is cancelled, postponed or rescheduled for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or entrant or their employer; or (g) participating in the Finals Event and the elit Art of the Martini Global Competition or taking/use/redemption of a prize.

 

  1. To be eligible to participate, each winner may be required to, as indicated by the Promoter, sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.  In addition, the Top Entrants, Finalist and Major Prize Winners may be required to sign an agreement, in a form determined by the Promoter in its absolute discretion, setting out the winner’s obligations with respect to participation in media interviews, photographic and video sessions, and other media related marketing, advertising, promotional and/or publicity activities. 

 

  1. The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, and prize suppliers. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at http://www.island2island.com.au/privacy-site-terms.php. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how individuals may opt out, access, update or correct their PI, how individuals may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter may disclose Australian individuals’ personal information to entities outside of Australia (see Privacy Policy for details).
